These Terms of Service (the "Terms") are an agreement between you and SES Technology Ventures LLC ("we", "us", "our") and govern your use of Boomstick City, including the website at boomstickcity.com, the game at play.boomstickcity.com, and related services (together, the "Game"). By creating an account or using the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Game. If you are under 18, you may use the Game only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your activity, including any purchases. The Game is not directed to children under 13, and we do not knowingly allow them to register.
2. Your account
You need an account to play. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity under your account. You may sign up with an email and password or, where offered, through a third-party sign-in such as Discord. Do not share your account, sell it, or let others use it. Tell us promptly if you believe your account has been compromised. You may have only one account unless we agree otherwise, and creating accounts to evade suspensions or limits is prohibited.
3. Display names and your content
You choose a display name and may provide other content (together, "User Content"). Your display name and profile may be visible to other players, including in matches, friend lists, and shared links. You are responsible for your User Content, and you agree not to use a name or content that is offensive, misleading, impersonates another person, or infringes anyone's rights. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and use your User Content to operate and promote the Game. We may remove or reclaim names or content that violate these Terms.
4. License to play
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and play the Game for your own non-commercial entertainment. All rights not expressly granted are reserved.
5. Acceptable use
When using the Game, you agree not to:
- cheat, use bots, automation, unauthorized third-party software, or exploit bugs;
- reverse engineer, decompile, scrape, or attempt to access non-public parts of the Game or its servers;
- harass, threaten, or abuse other players, or post unlawful, hateful, or infringing content;
- buy, sell, or trade accounts, virtual items, or currency outside the Game;
- disrupt, overload, or interfere with the Game, its security, or its infrastructure; or
- use the Game in violation of any applicable law.
We may investigate suspected violations and may suspend or terminate accounts that break these rules.
6. Virtual items and purchases
The Game includes virtual items and virtual currency, such as card packs, Gold, Scraps, and cosmetics ("Virtual Items"). Virtual Items are licensed to you, not sold, and they have no real-world monetary value. You do not own them, they cannot be redeemed for cash, and they may be modified, balanced, or discontinued at any time as the Game evolves.
Real-money purchases are processed by our payment provider, Stripe. Prices are shown before purchase and may exclude taxes, which are added where required. Except where the law requires otherwise, all purchases are final and non-refundable. Virtual Items and their availability may change, and unused Virtual Items are forfeited if your account is terminated for a violation of these Terms.
Consumers in the EU, the UK, and similar jurisdictions: digital content is delivered to you immediately. By making a purchase, you request immediate performance and acknowledge that you therefore lose any statutory right to withdraw or "cool off" once delivery has begun, except where the law provides otherwise.
7. Third-party services
The Game relies on third-party services, including Stripe for payments and Discord for optional sign-in. Your use of those services is also governed by their own terms and privacy policies, and we are not responsible for them. Our Privacy Policy explains what these providers receive.
8. Our intellectual property
The Game and its content, including its name, art, characters, cards, code, and design, are owned by SES Technology Ventures LLC or its licensors and are protected by intellectual property laws. Except for the limited license in Section 4, these Terms do not give you any right in our content, and you may not copy, distribute, sell, or create derivative works from it without our written permission.
9. Copyright complaints
We respect intellectual property rights. If you believe content in the Game infringes your copyright, contact us through our contact form with the details of your claim, and we will review it. We may remove infringing content and terminate repeat infringers.
10. Termination
You may stop using the Game and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to by law, or if we discontinue the Game. On termination, your license to play ends and you may lose access to your account and Virtual Items. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
11. Disclaimers
The Game is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, secure, or error-free. The Game is actively developed and may change, and features may be added, altered, or removed.
12. Limitation of liability
To the fullest extent permitted by law, SES Technology Ventures LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Game. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars (USD 50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold SES Technology Ventures LLC harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Game, your User Content, or your violation of these Terms or of any law or third-party right.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the date above, and where appropriate we will provide additional notice. Your continued use of the Game after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any dispute arising from these Terms or the Game.
16. General
These Terms and our Privacy Policy are the entire agreement between you and us regarding the Game. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control.
